1. Acceptance of Terms

By accessing or using KissAPI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

KissAPI provides a unified API gateway that enables developers to access various AI language models through a single, OpenAI-compatible endpoint. We act as an intermediary, routing your API requests to upstream AI model providers.

3. Account Registration

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials and API keys.
• You must be at least 18 years old to use the Service.
• One person or entity may not maintain more than one account without prior approval.

4. Acceptable Use

You agree NOT to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, or violates any applicable law
• Attempt to circumvent rate limits, abuse the system, or interfere with service operations
• Resell or redistribute API access without authorization
• Violate the acceptable use policies of upstream AI model providers
• Engage in any activity that could damage, disable, or impair the Service

5. Billing and Payments

• The Service operates on a prepaid, pay-as-you-go basis.
• You top up your account balance and usage is deducted based on token consumption.
• Payments are processed by our payment partner, Creem, acting as Merchant of Record.
• All sales are final. Refunds may be issued at our discretion for unused credits.
• We reserve the right to adjust pricing with reasonable notice.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service depends on third-party AI model providers, and availability may be affected by upstream outages, maintenance, or policy changes beyond our control.

7. API Keys and Security

• You are solely responsible for all activity that occurs under your API keys.
• You must keep your API keys confidential and not share them publicly.
• If you suspect unauthorized use, you must regenerate your keys immediately and contact support.

8. Intellectual Property

You retain all rights to the content you submit through the API. We claim no ownership over your prompts, inputs, or the outputs generated by AI models through our Service.

9. Limitation of Liability

To the maximum extent permitted by law, KissAPI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

10. Termination

• You may close your account at any time by contacting support.
• We may suspend or terminate your account if you violate these Terms.
• Upon termination, any remaining balance may be forfeited if the account was terminated due to a violation.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify registered users of significant changes via email.
